These Terms of Service ("Terms") are an agreement between you and JustPac LLC d/b/a DashClip, a Kentucky limited liability company ("DashClip," "we," "us," or "our"). They govern your use of thedashclip.com (the "Site") and your purchase of products and services from us (together, the "Services"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, and our Shipping, Returns & Refunds Policy, which are part of these Terms. If you do not agree, do not use the Services.

1. ELIGIBILITY

You must be at least 18 years old, or the age of majority where you live, to place an order. If you order on behalf of a company, club, or other organization, you confirm you have authority to bind it to these Terms.

2. ACCOUNTS

You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us right away at support@thedashclip.com if you believe your account has been used without permission.

3. ORDERS, PRICING, AND PAYMENT

  • All orders are subject to our acceptance. We may refuse or cancel any order, including for suspected fraud, errors in pricing or product information, inventory limits, or content that does not meet Section 4.

  • Prices are in U.S. dollars and may change without notice. Prices do not include shipping, handling, or applicable taxes, which are shown at checkout.

  • We try to display products, colors, and finishes accurately, but your screen may vary, and natural materials such as leather vary piece to piece.

  • If we discover a pricing error after you order, we will contact you to confirm the correct price or cancel the order with a full refund.

  • You authorize us and our payment processors to charge your selected payment method for the full order amount.

  • Promotional codes have no cash value, cannot be combined unless stated, and may be changed or ended at any time.

4. PERSONALIZED AND CUSTOM PRODUCTS

Many DashClip products are engraved or personalized to your instructions. When you submit names, text, dates, logos, artwork, or other content ("Personalization Content"):

  • Check your details. We produce your item exactly as entered or as shown on your approved proof. Please review spelling, capitalization, dates, and layout carefully. We are not responsible for errors in content you submit or approve.

  • You have the rights. You confirm you own or have permission to use all Personalization Content, including any logos, trademarks, club crests, or artwork, and that it does not infringe anyone's rights or violate any law.

  • We may decline content. We may refuse or cancel any order with content we consider infringing, offensive, defamatory, obscene, or otherwise inappropriate, in our sole discretion.

  • Limited license to us. You grant DashClip a limited, non-exclusive, royalty-free license to use your Personalization Content solely to produce your order, prepare proofs, provide support, and keep production records. We will not use it in our marketing without your permission.

  • Variation. Engraving placement, depth, and color may vary slightly because of materials and the production process.

  • Final sale. Personalized items are made to order and are final sale except as stated in our Shipping, Returns & Refunds Policy.

5. SHIPPING, RETURNS, AND REFUNDS

Shipping, delivery, returns, exchanges, and refunds are governed by our Shipping, Returns & Refunds Policy. Title and risk of loss pass to you when we hand your order to the carrier.

6. BUSINESS, WHOLESALE, AND EQUIPMENT CUSTOMERS

Orders from golf clubs, resorts, corporate accounts, resellers, and other business customers, and purchases of laser engraving equipment and related programs, may also be governed by a quote, invoice terms, or a separate written agreement. If those terms conflict with these Terms, the separate written terms control for that order.

7. INTELLECTUAL PROPERTY

The Site and all of its content — including the DashClip name and logo, DashTags™, Dashtech™, product designs, photography, text, graphics, and software — are owned by DashClip or its licensors and protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or use any of it for commercial purposes without our written permission. Product designs may not be copied or reverse-engineered.

8. REVIEWS AND SUBMISSIONS

If you post reviews, photos, comments, or other content, or send us ideas or suggestions, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, display, and adapt that content in connection with our business, including marketing. You confirm your submissions are truthful, are your own, and do not violate anyone's rights. We may remove any content at our discretion.

9. PROHIBITED USES

You agree not to: use the Services for any unlawful purpose; submit false or misleading information; infringe anyone's intellectual property or privacy rights; upload viruses or malicious code; scrape, crawl, or harvest data from the Site; interfere with the Site's security or operation; or buy products for unauthorized resale in violation of any agreement with us.

10. THIRD-PARTY LINKS AND TOOLS

The Site may include links to or tools from third parties (for example, payment, shipping, and review providers). We do not control and are not responsible for them, and your use of them is subject to their own terms.

11. PRODUCT WARRANTY AND DISCLAIMERS

Our products are covered only by any express warranty stated in our Shipping, Returns & Refunds Policy or on the product page. Equipment manufactured by third parties is covered only by that manufacturer's warranty, if any. EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted or error-free.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, DASHCLIP AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. Some states do not allow certain limitations, so some of these may not apply to you.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless DashClip and its owners, officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your Personalization Content or other submissions, your breach of these Terms, or your violation of any law or third-party right.

14. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us at support@thedashclip.com and try to resolve the dispute informally for at least 30 days. Any lawsuit must be brought only in the state or federal courts located in Jefferson County, Kentucky, and you and DashClip consent to the personal jurisdiction of those courts.

15. TERMINATION

We may suspend or end your access to the Services at any time if we believe you have violated these Terms. Sections that by their nature should survive — including intellectual property, submissions, disclaimers, limitation of liability, indemnification, and governing law — will survive.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time by posting the new version on this page and updating the "Last Updated" date. Changes apply to orders placed after they are posted. Your continued use of the Services means you accept the updated Terms.

17. GENERAL

These Terms, together with the policies referenced above and any written agreement for business orders, are the entire agreement between you and DashClip about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We are not liable for delays caused by events beyond our reasonable control.
